There are 3 types of alimony payments in Turkish law:

Child support (iştirak nafakası)

Material payment to the spouse (yoksulluk nafakası)

Temporary alimony (tedbir nafakası)

 

Child support is paid on the basis of a court decision to provide material support for the child.

A material payment to a spouse is a cash payment in favor of the spouse whose financial situation after the dissolution of the marriage will turn out to be more difficult.

Temporary alimony is payments that one of the parties to the marriage has the right to demand if it becomes impossible to live together in the same dwelling, and the marriage has not yet been dissolved.

The amount of alimony is determined by the court based on the financial situation of the party.

It should be noted that the material support of the spouse is terminated if the spouse who received this payment enters into a new marriage, or upon the death of the former spouse.

The fulfillment of the obligation to provide material support to the spouse terminates after the divorce proceedings, however, the party claiming this payment may apply to the court to extend this payment in the following cases:

- if the material need of one of the spouses arose in connection with the divorce;

- if the spouse is found guilty of divorce.

The family law laws of Turkey provide for the possibility of compensation for material damage from the spouse who became guilty of divorce, if the injured spouse became the cause of violence, aggression from the other spouse.

When entering into marriage, take care of drawing up a marriage contract, fix in it the right to a free choice of profession, the right to dispose of property, determine the place of residence of children in case of divorce and alimony obligations in case of divorce.
